1. Who we are and scope

Zugzwang Immo is a service of Zugzwang Studios, a sole proprietorship of Luis Arnold, Oberwilerstrasse 157, 4054 Basel, Switzerland (zugzwangxstudios@gmail.com). These terms apply to all orders placed through the order form on this website.

2. Business customers only

We sell exclusively to businesses: real estate agents, brokers, property managers and other real estate professionals acting in the course of their business. By placing an order you confirm that you are ordering as a business and not as a consumer. Rules that protect only consumers therefore do not apply to these contracts, to the extent permitted by law.

For now, our services are not offered for properties located in California. Please do not place orders for such properties.

3. The service and our commitments

We edit the photos of a property that you upload (up to 15 photos per property) using AI tools, and a person checks every image before delivery. Depending on the photo, editing covers perspective and framing, light and color, and – if you ask for it – the virtual removal of loose items such as dishes, laundry, toys, cables, bags and boxes (virtual decluttering). We do not add, remove or change permanent features such as walls, windows, doors, floors, fixtures, finishes or the view; if an AI edit does so, the image is corrected or not delivered. Your unaltered originals are delivered alongside the edited images.

4. Edited images and labelling

You are responsible for labelling edited images as edited in listings and advertising (e.g. “Digitally altered: clutter virtually removed; unaltered originals available”) and for using them in a way that does not mislead anyone about the property, in line with the advertising, real estate licensing and MLS rules that apply to you. We supply a ready-made statement and your unaltered originals for this purpose. Check every image before use and tell us about any difference from the actual property.

5. Your photos and rights

You confirm that you are entitled to use the uploaded photos and to have them edited (copyright, usage, privacy and publicity rights), and that any people shown and the owners or occupants of the property agree. You will indemnify us against third-party claims arising from a breach of this confirmation. You receive a perpetual right to use the edited images for the property concerned and its marketing. We use your photos only for your order and never as an example without your written consent.

6. Prices, taxes and payment

The prices shown on this website at the time of ordering apply, in US dollars (USD). The first property per customer is free. Payment is made in advance by card via Stripe. Pack credit (10 properties) is valid for 12 months from purchase and is not transferable; unused credit then expires.

Zugzwang Studios does not collect sales tax. All prices are final. Depending on the state in which you use our services, your business may owe use tax on the purchase and is responsible for reporting it.

7. Delivery time

Uploads are delivered within 2 hours, at any time of day and on any day of the week. The clock starts once the upload is complete and, for paid packages, payment has been received. Technical problems at our service providers or events beyond our control may cause delays; we will let you know by email.

8. Re-edits and money back

If you are not happy with an image, reply to the delivery email within 14 days of delivery. We will re-edit the image free of charge. If it is still not right, we will refund the price for the property concerned (for packs: one property credit).

9. Liability

We perform the service with reasonable care and skill. To the extent permitted by law, our total liability is limited to the amount you paid for the property concerned, and we are not liable for indirect or consequential loss (e.g. loss of profit, or a delayed lease or sale). Nothing in these terms limits liability that cannot be limited by law, including for intent, gross negligence or fraud. You are responsible for how the images are used in listings (section 4).

11. Governing law and jurisdiction

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The courts of Basel, Switzerland, have jurisdiction, to the extent permitted by law.
